The Round table “Which way to the new Constitution”

The Institute of Comparative Law and the magazine “Republika” have organized a round table intitled “Which way to the new Constitution”.  The introductory speech has been given by Ms Vesna Rakic Vodinelic, director of ICL, who emphasized that in the period between the October revolution and the present moment a number of laws has been adopted. These laws have been given a positive characteristic by OESC, EU and the Coucil of Europe, but their analysis can be subject to a different opinion. A new legal order, democratic by some of its characteristics, is being created, although it is not based on a breach with the Milosevic regime. Ms Vodinelic pointed out that in Serbia the notion of transition law, which englobes restitution, lustration and rehabilitation, is still unknown.

Nebojsa Popov, editor-in-chief of “Republika”, pointed out that citizens of Serbia demonstrated their will for democracy in several occasions – elections held in October 2000, funeral of prime minister Djindjic and by their actions against some of the new majority action holders in enterprises. Professor Pavle Nikolic emphasized that he was the first to propose the making of new Constitution, based on a breach with Milosevic regime, but that the idea of false legalism prevailed. Zoran Lutovac, counselor of the president of Serbia, pointed out that the working group writing the new Constitution is not linked to the Democratic party, but represents independent experts in Constitutional law. Slobodan Vucetic, president of Constitutional Court of Serbia, remarked that both model Constitutions benefit from the solutions already accepted by the European convention on human rights

SIGNING OF MEMORANDUM ON COOPERATION BETWEEN CENTER FOR CIVIL-MILITARY RELATIONS BELGRADE (CCMR) AND INSTITUTE OF COMPARATIVE LAW

CCMR and Institute of Comparative Law will sign Memorandum on Cooperation and Joint Acting on Defence System Reform Projects. Goal of this cooperation will be uniting scientific and expert capabilities on further realization of legal reform of defence system of Serbia & Montenegro. Formal occasion will be a chance for experts of both organisations to present their accomplishments in this field of acting, as well as the current state analysis of our defence system and its legal framework and possible direction of further activities.

ROUND TABLE “CHANGES IN PROPERTY RELATIONS LEGAL FRAMEWORK IN SERBIA – POSSIBILITIES OF REFORM WITHIN THE SCOPE OF REGIONAL DEVELOPMENTS IN SOUTH-EAST EUROPE”

 GTZ Foundation and Institute of Comparative Law organize round table within the project “Support of Legal Reforms in Serbia & Montenegro”. This occasion will be a chance for expert team of the Institute to present the results of the project realized in 2004. Gathering will be opened by Mr.Thomas Meyer from GTZ, following the welcoming speech of Mr. Folkert Milch from OECD and Mrs. Vesna Rakić-Vodinelić, director of Institute of Comparative Law.

NEW PUBLICATION OF INSTITUTE OF COMPARATIVE LAW – MONOGRAPH “LEGAL ASPECTS OF DEFENCE SYSTEM REFORM”

Institute of Comparative Law published new monograph within the scope of  the project “Legal Reform of Defence System”. Monograph consist of comparative studies of reforms of South-East European countries, review of defence system of Kingdom of Norway, critical analysis of reforms in Yugoslavia / Serbia & Montenegro from 1990, as well as the analysis of the NATO membership minimum standards and  joining procedures. Also, monograph contains the draft proposal of the “Legal Reform Action Plan for Serbia and Montenegro”.

Monograph is available at the Institute of Comparative Law free of charge.
